ESA or Easy Sales Automation (CRM) (“Company”, “we”, “us”, or “our”) is committed to protecting the privacy and security of the personal information that our clients and their users (“Customers”, “you”, or “your”) provide to us. This Privacy Policy describes our practices with respect to the collection, use, disclosure, and protection of personal information, as well as the choices you have with respect to your personal information.
Scope
This Privacy Policy applies to all personal information collected by the Company in connection with the provision of our third-party tools and softwares (rebranded and/or non-rebranded) as a service (“Service”), including personal information provided to us by our clients/users or their customers..

We may, however, share personal information with third-party service providers who perform services on our behalf, such as hosting and maintenance of the Service, or providing customer support. License to Use: Easy Sales Automation grants Users a limited, non-exclusive, non-transferable license to use the Software, subject to the terms and conditions set forth in this TOS. The User agrees not to modify, reverse engineer, decompile, or disassemble the Software or create derivative works based on the Software.
Ownership: The User acknowledges that Easy Sales Automation is the sole owner of all intellectual property rights in the Software, including all patents, trademarks, copyrights, trade secrets, and other proprietary rights. The User agrees not to use any of Easy Sales Automation's intellectual property rights except as expressly permitted by this TOS.
User Data: Easy Sales Automation may collect and use information related to User's use of the Software, including, but not limited to User data and User preferences (“User Data”). Easy Sales Automation agrees to use User Data only in accordance with Easy Sales Automation's privacy policy and applicable laws.
User Responsibilities: The User is solely responsible for the use of the Software and for any data, information, or content transmitted, uploaded, or otherwise made available through the use of the Software. The User agrees to use the Software only for lawful purposes and in accordance with this TOS. The User agrees not to use the Software to:
Limitation of Liability: Easy Sales Automation shall not be liable to User or any third party for any damages arising from the use of the Software, including, but not limited to, indirect, special, incidental, or consequential damages, even if Easy Sales Automation has been advised of the possibility of such damages.
Termination: Easy Sales Automation may terminate this TOS and User's license to use the Software at any time and for any reason. Upon termination, the User agrees to stop using the Software and to destroy any copies of the Software in their possession.
Governing Law: This TOS shall be governed by and construed in accordance with the laws of the Texas, USA and any applicable federal laws.
Entire Agreement: This TOS constitutes the entire agreement between Easy Sales Automation (ESA) and User with respect to the use of the Software and supersedes all prior agreements and understandings, whether written or oral, relating to the subject matter of this TOS.
Modification: Easy Sales Automation reserves the right to modify this TOS at any time,
Introduction
This agreement sets forth the terms and conditions under which the client shall use the services provided by ESA or Easy Sales Automation. The client acknowledges and agrees to comply with these terms and conditions as a precondition to the use of the services.
Non-Compete
The client has agreed not to engage in any competition with ESA (Easy Sales Automation) and to not use any information, products, or services provided by ESA for any actions that may harm the company's interests. This commitment will last for a minimum of 6 months to a maximum of 2 years after the termination of this agreement.
Pricing
ESA or Easy Sales Automation reserves the right to change its pricing at any time due to unforeseen circumstances or changes in the cost of the tools and resources used to provide the services. The client will be notified of any such changes.
No Refund Policy with Cancel Anytime Option
At ESA, we are dedicated to providing a valuable and satisfying experience for our customers. However we operate on a subscription-based model, granting access to our platform and its features. While we have a strict "No Refund" policy, we do offer a "Cancel Anytime" option to ensure flexibility for our subscribers. We have outlined the details of our policy below:

Payment
If a payment fails to process, the system at ESA (Easy Sales Automation) will make another attempt to process the payment three days later. However, it is important to note that ESA has no control over the processes of Stripe, which is the third-party payment processor used by the company. If the payment still cannot be processed after this time, the client's subscription will be automatically canceled within Stripe and on our platform (ESA CRM). It is important for the client to ensure that their payment information is up to date in order to avoid any disruption in service, as ESA has no influence over the actions taken by Stripe.
Account Cancellation
When or if a client's subscription with ESA (Easy Sales Automation) is canceled, their account will be put on hold and they will lose access to all services provided by the company. If the client wishes to reinstate their account, they may experience temporary loss of access and may not receive the same subscription pricing that they had previously. The client will need to renew their subscription at the updated pricing and will not be eligible for a trial period (again). It is important for the client to understand that reinstating their subscription after cancellation may result in changes to the terms and conditions, including a different pricing structure, a lack of a trial period and the possibility of being unable to do business with ESA in the future.
Sufficient Balance
The client is responsible for ensuring that their telephony/email wallet remains credited in order to avoid any interruption in their service, including the ability to send and receive emails, SMS, and phone calls. To prevent loss of access to their account, the client must make sure that the credit card on file has sufficient funds and is not expired. It is important to note that the automatic cancellation of subscriptions is executed by the payment processor and the client cannot hold ESA (Easy Sales Automation) responsible for any downtime or loss of data that may occur as a result. In order to prevent any interruption in their services, it is the client's responsibility to regularly check and maintain their telephony/email wallet balance.
Acceptance
By using ESA or Easy Sales Automation’s services, the client acknowledges and agrees to comply with the terms and conditions set forth in this agreement. ESA or Easy Sales Automation reserves the right to modify this agreement at any time and the client agrees to be bound by any such modifications.
